Update: The Government was unsuccessful in getting the plaintiff’s case dismissed at the Court of Appeal, but the plaintiff’s application for certification is remitted back to trial court to address a number of issues.

Next stage: the scheduling of the re-certification hearing and revision of the pleadings/common issues before the trial judge, further to the order of the Court of Appeal.  Date pending.
